Maintaining a high level of trust and confidence for those who interact with us is critically important to AgCountry Farm Credit Services, ACA (AgCountry®, Us or We). We are committed to making sure that your interactions with Us are safe, secure and that We are transparent in how We use your personal and private information.

We have implemented procedures, systems, and controls designed to safeguard personal information and prevent improper disclosures of that information. This Privacy Statement explains generally how we receive personal information about you and what we do with that personal information once we have it.

 

What do we mean by Personal Information?
"Personal Information" means information or data that can be linked directly or indirectly to an individual. Personal Information relates to, describes, or is reasonably capable of being associated with an individual or household.

What type of Personal Information do we collect?
We may collect data, including Personal Information, about you as you use our website, services, products and interact with Us. The following are categories of Personal Information that have been collected by Us about individuals within the last twelve (12) months. The examples listed provide a description of information within each category that may be collected for our various products and services.

Note: Personal information does not include other information such as publicly available information from government records or de-identified or aggregated consumer information (data from which Personal Information has been removed).

Identifiers. Fire and last name, alias, postal address, email address, phone number

Personal classification characteristics. Age, race, citizenship, martial status, medical condition, sex (including gender, gender identity, gender expression), and veteran or military status.
Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
Internet or other similar network activity. Internet Protocol (IP) address, browsing history, search history, information on interaction with a website, application or advertisement. 
Audio, electronic, visual or similar information. Call recordings when you contact our offices. Photo IDS.
Professional or employment-related information. Current or past employment history. 

Children's Online Privacy Protection Act
Our websites are not intended for, nor do We conduct business with, children under the age of 13. If a parent or guardian becomes aware that his or her child has provided Us Personal Information without their consent, he or she should promptly contact AgCountry and We will delete such information from our files. How do we receive personal information about you?
Information you give to AgCountry. When you make an application for financing or other products and services provided by Us, We collect information necessary to provide such products and/or services to you.
When you access our websites, We collect information about the device you use, the login information you provide, such as: your Internet domain (e.g., xcompany.com), IP address (a number automatically assigned to your computer when you are using the Internet), and mobile device’s unique identifier from which you access our Website; the type of browser and operating system used to access our Website; the date and time you access our Website; the pages you visit; and the address of the Website from which you linked to our Website.
When you communicate with AgCountry via email, telephone or other means, We may collect your email address, phone number, or other related information.
Information obtained from third parties. We may obtain information about you from third parties, including other Farm Credit institutions with whom We partner to provide you services, credit reporting agencies, and other financial institutions with whom We transact business on your behalf.

How do we use your personal information?
Provide Services. We use your Personal Information in order to provide you with our financing or financing through a specific third party with your consent, and other services, make credit decisions, and to fulfill our contractual obligations to you.
Communicate. We use Personal Information to communicate with you about our products or services. We may also use your Personal Information to send you account updates or other communications regarding your account or to inform you of any changes to our products or services.
Marketing. We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information.
Specific Purposes. You may be asked to provide information for a specific purpose. For example, We may request that you fill out a survey to provide us with feedback on our technical support.
Legal Requirements. We also collect data to meet legal requirements, such as collecting information to comply with relevant anti-discrimination laws or to satisfy our regulators.
Customer Support. We may use your Personal Information to provide you support or other services you request. For example, We may need your information in order to provide technical support or answer questions about our products or services.
Maintenance and Improvement. We analyze how our users interact with our website in order to maintain and improve it. We also use information that We collect to diagnose any problems with our website to improve the user experience. We also use information We collect to improve our product and service offerings.

When do we share personal information with others?
We do not sell your Personal Information. We do share your information with our employees, contractors, agents, affiliates, Collaborating Associations, third-party service providers, independent auditors, regulators, consultants, attorneys, and other parties as described below:
With Your Consent. We may request your permission to use or share your Personal Information for a specific purpose. Generally, We will notify you and request consent before you provide the Personal Information or before the Personal Information you have already provided is shared for such purpose. Examples include sharing information to provide you with a loan via the Rural 1st® consumer lending program or to facilitate a lease through Farm Credit Leasing. Consents received for other purposes, such as consent to communicate via text, email, or other method are not, alone, considered a consent to share Personal Information.
Service Providers. We may share information with service providers that help us perform Site functions and administer our services. For example, We may share your information with third-party customer service providers.
Corporate Family and Affiliates.  We share information within our corporate family, such as with subsidiaries or affiliates to the extent permitted by law. Affiliates of AgCountry Farm Credit Services, ACA, include AgCountry Farm Credit Services, FLCA, and AgCountry Farm Credit Services, PCA. Additionally, AgCountry Farm Credit Services, ACA, and its affiliates are managed and operated jointly and share information with Farm Credit Services of America, ACA and its affiliates and Frontier Farm Credit, ACA, and its affiliates, pursuant to a Collaboration agreement between these associations.
AgDirect® Equipment Financing Program. We may share information with AgDirect, LLP, and its partners in connection with financing or services provided through the AgDirect equipment financing program. AgDirect is an equipment financing program offered by Farm Credit Services of America and other participating Farm Credit System institutions with lease financing provided by Farm Credit Leasing Services Corporation.
Corporate Structure. We may share information in connection with a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or if We undergo bankruptcy or liquidation.
To Prevent Harm. We may share information if We believe it is necessary in order to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.
For Legal Purposes. We will share information where We are legally required to do so, such as in response to requests from our regulator, other Farm Credit System institutions for purposes allowed by law, court orders or legal process, to establish, protect, or exercise our legal rights, to defend against legal claims or demands, or to comply with the requirements of any mandatory applicable law. With Others under Duty of Confidentiality. We may share information with others for the purpose of conducting business when the other party is under a contractual duty of confidentiality.
 
How do we protect your Personal Information?
We hold any information customers give Us in strict confidence, and We safeguard personal information according to strict standards of security. We limit the information that We collect to the amount required to deliver extraordinary service to our customers. Our computer systems include software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. Unauthorized attempts to upload information or change information on this service are strictly prohibited and will be reported to law enforcement when appropriate or required. How can you protect your Personal Information?
Electronic communication (e.g., email, online chat or instant messaging, etc.) you send to Us may not be secure unless We advise you in advance that security measures will be in place prior to you transmitting the information. For this reason, We ask you do not send Personal Information such as financial information, social security numbers or passwords to us through unsecured electronic communication. Individuals should also take care with how they handle and disclose their Personal Information. While We do our best to provide you with helpful, trustworthy resources, We cannot endorse, approve or guarantee Information, products, services, or recommendations provided at a third-party website. AgCountry is not responsible for the content or accuracy of any third-party websites. AgCountry will not be responsible for any damage of any sort resulting from the use of a third-party link on our websites nor will AgCountry be liable for any failure of products or services advertised or provided on these linked third-party websites.

All third-party website links are made available to you on an "as is" basis. Data collection, use and security practices of the linked third-party website may differ from the provisions of this Privacy Statement.

How do we use tracking technologies like cookies?
A "cookie" is a small piece of data (text file) that a website - when visited by you - asks your browser to store on your device in order to remember information about you. Cookies assist in your navigation of our websites, your registration for events, login, and your ability to provide feedback, analyzing your use of our products, services or application, and assisting with our promotional and marketing efforts. How do we handle your "Do Not Track" browser settings?
Some browsers have an optional setting called "Do Not Track" (DNT). Do Not Track signals are features of browsers which allow consumers to opt-out of being tracked by ad networks, analytics services and social media platforms. Our websites do not respond to these signals or similar mechanisms.

Our App may ask you to grant permissions including:

While using these permissions are optional, the corresponding purpose may not be achieved if you do not accept the relevant permission. For instance, if you choose not to grant permission for the camera, you will not be able to make a remote check capture.

What if we change the Privacy Statement?
We will make changes to this Privacy Statement from time to time. This helps us stay up to date with changes to our business and the most current laws. Unless otherwise required, the updates will be posted online. Unless further steps are necessary related to the changes, your continued use of our products or services after the effective date of such changes constitutes your acceptance of such changes. To make your review more convenient, we will post an effective date at the top of this Privacy Statement.
